Grounds
Unlike most states, the law in New York still requires a party to prove "grounds" in order to obtain a divorce. While the issue of grounds is usually settled or resolved between the parties, on certain occasions a party may be required to prove grounds at a trial in order to obtain a divorce. The grounds for divorce in New York are as follows:
- Constructive Abandonment
- Actual Abandonment
- Adultery
- Cruel and Inhuman Treatment
- Legal Separation
